Devlet, unsurları ve kişiliği

Abstract

Devlet kavramı, kişilerin yorum tarzına göre değişik anlamlarda kullanılmaktadır. Kimisine göre, sadece kuvvet ve iktidar, kimisine göre her çeşit kudret ve fazilet kaynağı, yine bazılarına göre hükmi bir şahıs veya müessesedir. Sözlük anlamı olarak Devlet, “Bir hükümete ve ortak kanunlara bağlı teşkilatlı millet veya milletler topluluğu” olarak tanımlanmaktadır. Devlet bir bakıma, aralarında dayanışma ve otorite bağları bulunan ve bir yurtta yaşayan devamlı bir fertler topluluğudur. Fertler veya aileler devamlı bir üstün otoriteyi kabullenmeden yaşadıkları sürece, Devlet’ten söz edilemez. Ancak bu kabullenmeyle Devlet’ten bahsedilir. Devlet, kendini meydana getirenlere birtakım hizmetlerde bulunur. Görevler üstlenir. Esasında Devlet, onu meydana getiren kişilerden oluşmaktadır. Devleti onun adına hareket eden insanlardan farklı olarak düşünmek mümkün değildir. Devlet otoritesinden söz edildiğinde o otoriteyi kullananlar, devlet düzeninden söz edildiğinde o düzeni faaliyete geçirenler, devletin yasalarından bahsedildiğinde o yasaları yapanlar gerçekte fertlerdir.

The concept of the state is open to interpretation of individual opinions. For some people it only means power and ability, for some people unhampered capability and potency for others a judicial person or establishment. The dictionary definition of a state is “an organized nation or group of people who ruled by a government and has common laws.” In a way the state can be described as a group of people linked by authority and solidarity that live in a common land. If the superior authority has not been accepted by individuals and families there will be no mention of a state. This is the only way the state can exist. It serves its people and takes on duties. In fact, the state consists of the individuals within. It is impossible to think of the state and its people separately. When it comes to authority of a state, in fact, it is the people who use that authority. Legislators make state laws. Similarly, it is the people who enforce the order of the state that maintain the state’s existence.
